These Terms of Service ("Terms") govern your access to and use of the Nexa AI website and mobile applications (the "Service") operated by Nexa AI Sdn. Bhd. ("Nexa AI", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

Nexa AI provides AI-powered photo and video enhancement tools. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

2. Your Content

You retain all rights to the photos and videos you upload. By uploading content, you grant us a limited license to process it solely for the purpose of providing the enhancement features you request.

You are responsible for the content you upload and must have the necessary rights to it. You must not upload content that is unlawful, infringes the rights of others, or contains harmful material.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws;
  • Upload content that infringes intellectual property rights or privacy rights of others;
  • Attempt to reverse engineer, decompile, or extract the source code or models of the Service;
  • Use automated means to access the Service or circumvent usage limits;
  • Use enhanced outputs to mislead, defraud, or impersonate any person.

4. Purchases & Subscriptions

Certain features may require payment or a subscription. Prices, billing cycles, and refund terms will be presented at the point of purchase. Purchases made through app stores are also subject to the respective store's terms and refund policies.

5. Intellectual Property

The Service, including its software, design, and branding, is owned by Nexa AI Sdn. Bhd. and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. AI-generated enhancements may contain inaccuracies or artifacts; we do not guarantee any particular result.

7. Limitation of Liability

To the maximum extent permitted by law, Nexa AI Sdn. Bhd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service.

8. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

9. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore.
